Good evening Temecula and welcome back to TMTV News. I’m your host, Brenda Johnson, and tonight we’re talking about trusts. Joining us is Steve Bliss, a renowned Trust Attorney here in Temecula. Welcome to the show, Steve.
Steve Bliss:
Thanks for having me, Brenda. It’s great to be here.
What type of trust do you find most beneficial for your clients?
Steve Bliss:
That’s a great question. While there are many types of trusts, I often recommend Revocable Living Trusts to my clients. They offer a lot of flexibility and benefits.
A revocable living trust allows the grantor, the person creating the trust, to maintain control over their assets during their lifetime. They can change the terms of the trust, add or remove beneficiaries, and even dissolve it entirely if they wish. Consequently, this provides peace of mind knowing their wishes will be followed.
Moreover, upon the grantor’s passing, the assets in a revocable living trust bypass probate. Probate is a lengthy and often expensive court process, so avoiding it saves time, money, and stress for loved ones. Notwithstanding these advantages, it’s crucial to work with an experienced attorney when setting up a trust to ensure it meets your specific needs.
Can you elaborate on the benefits of avoiding probate?
Steve Bliss:
Absolutely. Probate is a public process, meaning anyone can access information about your estate, including assets and beneficiaries. This lack of privacy can be concerning for some people.
Additionally, probate can take months or even years to complete, leaving beneficiaries in limbo while waiting for their inheritance. By using a revocable living trust, you can ensure your assets are distributed promptly and privately according to your wishes.
Have there ever been any challenges with setting up or administering a revocable living trust?
I recall one instance where a client had complex family dynamics and wanted to ensure certain assets went to specific individuals while excluding others. We worked closely together to craft the trust language in a way that addressed her concerns and minimized potential conflicts.
It’s important to remember that every individual and family situation is unique. That’s why I always encourage open communication and thorough planning when it comes to estate matters.
Do you have any statistics about the prevalence of revocable living trusts?
According to a recent study by the American Bar Association, over 50% of Americans with assets exceeding $1 million utilize some form of trust in their estate plan. This highlights the growing recognition of the benefits and versatility of trusts for protecting assets and ensuring smooth wealth transfer.
What advice would you give to someone considering setting up a trust?
My best advice is to consult with an experienced estate planning attorney. We can help you determine if a revocable living trust is right for your situation, guide you through the process, and ensure all legal requirements are met.
Remember, planning for the future brings peace of mind and protects your loved ones.
