What is the most overlooked aspect of estate planning, in your experience?

Ted Cook: That’s a great question, Beatrice. I’d say it’s truly understanding the ‘why’ behind the planning. People often focus on the documents – the will, the trust – but they don’t fully articulate their goals and priorities. They haven’t thought deeply about what’s most important to them, what values they want to uphold, and how they want their legacy to be defined. This foundational work is crucial because it informs every decision we make throughout the planning process.

It’s like building a house – you need a strong blueprint before you start laying bricks. If you skip that step, you end up with a structure that’s unstable and doesn’t meet your needs. We spend a lot of time with clients helping them clarify their vision – discussing their family dynamics, their charitable intentions, their concerns about potential conflicts, and their hopes for the future.

This involves a thorough exploration of not just *what* they own, but *who* they want to benefit, *how* they want those benefits distributed, and *when*. For example, are they concerned about providing long-term care for a special needs child? Do they want to establish a foundation to support a particular cause? Are they worried about protecting their assets from creditors?

We also delve into things like their digital assets – social media accounts, online photos, cryptocurrency – and how they want those handled. It’s a surprisingly complex area that many people overlook. Ultimately, the goal is to create a plan that reflects their unique circumstances, values, and aspirations. It’s not a one-size-fits-all process, and we tailor each plan to meet the individual needs of our clients. We’ve found that when people take the time to truly define their ‘why’, the rest of the process flows much more smoothly.

Could you elaborate on step ‘H’ – Organizing and Storing Your Documents? What are the biggest pitfalls people encounter with this final stage?

Ted Cook: Absolutely, Beatrice. It’s amazing how often this crucial final step gets neglected! People spend months, even years, creating their estate plan, but then they file the documents away in a shoebox or a random drawer, and no one knows where they are. That defeats the whole purpose! Think of it like this: you’ve built a beautiful ship, but you haven’t provided a map or a compass. It’s going to be very difficult for your loved ones to navigate the waters after you’re gone.

The biggest pitfalls are accessibility and security. Many people worry about keeping their documents safe from theft or damage, so they hide them in obscure places – like behind a painting or in the attic. But that makes it very difficult for their executor to find them when they’re needed. We recommend a balance between security and accessibility. A fireproof safe is a good option, but it’s important to let your executor and trustee know where the key is.

We also advise clients to create a detailed inventory of their assets and liabilities, and to keep that inventory in a safe place along with their estate planning documents. It’s also a good idea to digitize important documents and store them securely in the cloud. But make sure your executor knows your login credentials! We’ve encountered numerous situations where clients had digital assets that were impossible to access because their families didn’t know their passwords.

Finally, it’s important to review and update your estate plan regularly – at least every three to five years, or whenever there’s a significant life event, such as a marriage, divorce, birth of a child, or major change in your financial situation. A well-organized and up-to-date estate plan can save your loved ones a lot of time, stress, and expense after you’re gone. It’s a final act of love and responsibility.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
