Hello everyone and welcome back to another insightful interview. Today, I have the pleasure of sitting down with Ted Cook, a probate attorney right here in sunny San Diego. Ted, thanks for taking the time to chat with me today.
So, Ted, tell us: what exactly is probate and why should folks even care?
“Well,” Ted begins, leaning back in his chair, “probate is essentially the legal process of administering a deceased person’s estate. It involves identifying and inventorying their assets, paying off debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will or state law.”
“It’s something that most people don’t think about until they need it,” Ted continues with a chuckle. “But understanding the basics of probate can save your loved ones a lot of stress and headache down the road. Trust me, you don’t want to leave them scrambling to figure things out during an already difficult time.”
Let’s delve into one specific step in the process. Could you walk us through “Handling Debts and Taxes”?
Ted nods enthusiastically. “That’s a crucial stage, for sure. Once all the assets are identified and inventoried, we need to determine what debts the estate owes – think mortgages, credit card bills, medical expenses, you name it.
We then have to pay those valid debts from the estate funds. It’s important to remember that creditors have a right to be paid, even after someone passes away. Next comes handling any taxes owed by the estate – federal estate tax, state inheritance tax, and potentially property taxes.
- “It can get complicated,” Ted admits. “There are specific deadlines and procedures we need to follow to ensure everything is done correctly and legally.
- That’s why it’s vital to have an experienced probate attorney guide you through the process.”
“I recall one case,” Ted shares, leaning forward slightly. “The deceased had a significant amount of unpaid medical bills. We were able to negotiate with the hospital and settle for a reduced amount, which saved the estate thousands of dollars.

Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.

In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
