What are some of the biggest challenges you face in your work?
One of the most difficult things is often simply getting seniors to recognize they are being mistreated. Many individuals are hesitant to speak up out of fear, embarrassment, or a misplaced sense of loyalty towards their abuser. It takes a lot of patience and compassion to build trust with these vulnerable clients.
Let’s dive into the Elder Protection process a bit. Can you walk us through one of the key steps?
Sure thing. Today let’s talk about ‘Protective Actions.’ This stage often kicks in when we’ve identified a clear and present danger to an elder’s well-being.
Protective Actions: What are some of the measures you might take during this phase?
Depending on the severity of the situation, protective actions can range from filing for restraining orders against abusers to initiating guardianship or conservatorship proceedings if someone lacks the capacity to make sound decisions for themselves. We also work closely with Adult Protective Services (APS) and law enforcement agencies to ensure the safety and well-being of our clients.
- “Freezing bank accounts can be a critical step in preventing further financial exploitation,” Ted explains.
“Our goal is always to empower seniors and restore their sense of agency. Sometimes, that means taking legal action against those who have violated their trust.”
A few years ago, I had a case involving an elderly woman who was being financially exploited by her own granddaughter. The granddaughter was forging checks, draining the grandmother’s bank accounts, and isolating her from family and friends. We were able to intervene quickly, secure a restraining order against the granddaughter, and appoint a trusted family member as guardian.
There was another instance where a client was suffering from dementia and being neglected in an assisted living facility. We worked with APS and ultimately secured a court order requiring the facility to provide better care.
