Steve, can you give our viewers a basic understanding of what probate is and why it’s important?
“Probate is essentially the legal process of administering a deceased person’s estate,” explains Steve. “It involves identifying and valuing assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will or state law. Probate ensures that everything is handled legally and ethically.”
Focusing on Asset Inventory
Today we want to delve into a specific step in the probate process: marshalling estate assets.
“Marshalling estate assets is crucial because it forms the foundation for the entire probate process,” emphasizes Steve. “This step involves meticulously inventorying all of the deceased person’s assets, including bank accounts, real estate, vehicles, investments, and personal belongings. Every item needs to be accounted for.”
He continues, “Once we have a complete inventory, we then need to appraise each asset to determine its fair market value at the time of death. This information is essential for calculating any taxes owed and ensuring that assets are distributed fairly among heirs.”
Steve goes on to explain that this process can sometimes be complex, especially if the deceased person had numerous or diverse assets. “Consequently, accurate record-keeping and attention to detail are paramount during asset inventory.
“Notwithstanding these challenges,” Steve adds, “successfully completing this step provides a clear picture of the estate’s financial standing, allowing for efficient and transparent administration throughout the rest of the probate process.”
Challenges and Triumphs
Steve, have you encountered any unique situations or challenges during asset inventory?
He pauses thoughtfully before sharing, “I recall a case where a client’s father had been an avid collector of rare coins. Locating and valuing these coins proved to be quite a task, requiring consultations with numismatic experts. In the end, the collection turned out to be worth significantly more than initially anticipated, providing a substantial benefit to the heirs.”
“Conversely, I’ve also encountered cases where individuals failed to keep accurate records of their assets,” Steve notes. “This can lead to delays and complications during probate, underscoring the importance of good financial organization throughout one’s life.”

Steve, what advice would you give to our viewers regarding asset inventory and probate preparation?
“My biggest recommendation is to be proactive,” advises Steve. “Maintain detailed records of your assets, including account statements, deeds, and insurance policies. Discuss your wishes with loved ones and consider creating a will or trust to ensure your estate is distributed according to your intentions.”
He concludes, “Remember, proper planning can save your family time, stress, and financial burden in the long run.”
